There’s a lot of misconception about CBD being legal from retailers, consumers, banks, insurance companies…the list goes on. Misinformation is all over the place! We’re here to help clarify and give you the facts! To start, we need to understand that hemp and marijuana are very different in terms of CBD and THC levels. Hemp contains high amounts of CBD and low amounts of THC. Marijuana is the opposite, containing high amounts of THC and low amounts of CBD. Now, hemp-derived CBD is legal at the federal level for products containing less than 0.3% THC. The current legal status of hemp is defined by the 2018 Farm Bill, under which companies may obtain licensing to legally grow, manufacture, possess, and sell hemp-derived CBD products. Transportation across state borders is legal as well. However, there are some states where CBD is still illegal or have very strict guidelines which prohibit Marmalade Lane from shipping products to Hawaii, Idaho, Iowa, Mississippi, New Hampshire, and South Dakota. All Marmalade Lane products are always well below the 0.3% THC limit and compliant with federal and Wisconsin state laws. Our consumers may request third party test results from us at any time. Marijuana-derived CBD is illegal at the federal level due to its higher levels of THC and psychoactive effects. Hopefully this article was able to provide some clarification.
